E-2 Visa for South Korean Citizens: Requirements, Seoul Processing and Business Choices
South Korea is one of the largest E-2 nationalities. Here is how the process works through the Seoul consulate, what officers expect, and which businesses Korean investors succeed with.
South Korea is consistently among the top nationalities for E-2 issuances. Korean investors run restaurants, beauty and skincare businesses, education centers, trading companies and franchises across Los Angeles, Atlanta, Dallas, New York, Seattle and Northern Virginia. Eligibility
South Korea is an E-2 treaty country. Korean citizens qualify; the U.S. business must be at least 50% owned by Korean citizens (or nationals of another single treaty country if a dual national applies on that passport). All general requirements apply: a substantial at-risk investment, a real operating business, non-marginality and an active role in directing it. See the complete E-2 guide.
Korean citizens receive E-2 visas valid for up to 60 months with multiple entries. Each entry grants a two-year period of stay.
Applying from Korea
The U.S. Embassy in Seoul processes E-2 applications through its E-visa unit:
- DS-160 for each applicant and DS-156E for the principal.
- Visa fee of $315 per applicant.
- Electronic submission of the evidence package following the embassy’s file organization rules.
- Document review, typically two to six weeks for a complete package.
- Interview, scheduled one to three weeks after review. Interviews are in English; Korean-language support is available for dependents.
- Passport returned with the visa within about a week.
Korean applicants already in the U.S., often on F-1 or H-1B, can change status through USCIS instead and obtain the visa at Seoul later. See change of status vs consular.
Source of funds from Korea
Seoul reviews source of funds carefully. Common sources and evidence:
- Sale of an apartment: registered sale contract, real estate registry extract, bank receipt of proceeds, and capital gains tax filing.
- Savings and salary: employment certificate, income tax withholding receipts, bank history over several years.
- Business income: business registration, corporate tax returns, dividend records.
- Gifts from parents: a gift contract, gift tax filing where applicable, and the donor’s source documents. Parental gifts are common in Korean cases and are accepted when documented.
- Currency transfer: Korean banks require documentation for outbound transfers above thresholds; keep the foreign exchange transaction records, which reconcile won to dollars.
Investment amounts
Korean approvals follow the general pattern: $100,000 to $200,000 for service and franchise businesses, $200,000 to $500,000 for restaurants, beauty and education centers, and more for acquisitions. Seoul accepts escrow arrangements for acquisitions when properly drafted. See minimum investment.
Businesses that work for Korean investors
- Korean and Japanese restaurants, cafes and dessert concepts, especially in Los Angeles, Orange County, Atlanta, Dallas and Northern Virginia.
- Beauty, skincare, nails and wellness concepts, often with licensed staff and retail components.
- Education and tutoring centers, test preparation and language schools.
- Trading and import companies with U.S. warehousing and staff.
- Franchises in home services, food and fitness.
- Acquisitions of established businesses in Korean-American commercial districts.
Family
Spouses and children under 21 receive E-2 dependent visas. Spouses may work for any employer; children attend public school and often qualify for in-state tuition after residency requirements. See E-2 for families.

- Military service: men with pending service obligations should resolve permissions before relocating.
